Terms of Service

These terms govern your use of heybinny.com and the HeyBinny text message service. By signing up or texting our keyword, you agree to them.
What HeyBinny does
HeyBinny sends free text reminders the night before your scheduled trash and recycling pickup, alerts when trucks are running late, and notices when holidays or weather shift the schedule, for participating neighborhoods in Colorado Springs. We also arrange optional paid services on request, such as extra pickups, bin cleaning, and junk removal.
We are independent
HeyBinny is not affiliated with, endorsed by, or acting on behalf of any waste hauler or the City of Colorado Springs. Hauler names are used only to identify which schedule applies to you. Your service agreement remains with your hauler.
Signing up
You must be at least 18 years old and use a mobile number you are authorized to enroll. After you sign up, we send one confirmation text; your subscription begins when you reply YES. Consent to receive texts is not a condition of purchasing anything.
Messages and cost
The reminder service is free. Expect roughly four to eight messages per month, more during weeks with delays or holiday schedule changes. Message and data rates may apply depending on your mobile plan. Wireless carriers are not liable for delayed or undelivered messages.
Opting out
Reply STOP to any message to end all messages. Reply HELP for assistance. If you opted in with incorrect information, reply and tell us, or text STOP and sign up again with the correct details.
Your responsibilities
- Give accurate information at sign-up, and tell us when your address or hauler changes.
- Do not submit false reports of missed or late pickups. Our delay alerts depend on honest reports from neighbors.
- Do not use the service or our number for automated, bulk, unlawful, or abusive purposes.
Paid services
Any paid service is quoted before work begins and paid through our payment processor. Work may be performed by us or by a local provider we arrange. Scheduling depends on availability, and cancellations or refunds are handled case by case in good faith.
Suspension
We may suspend or remove any subscriber who abuses the service, submits false reports, or whose number is invalid or unreachable.
Our content
The HeyBinny name, the Binny mascot, and the content of this site belong to us and may not be copied or used commercially without permission.
Disclaimer of warranties
The service is provided as is and as available, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent permitted by law, HeyBinny is not liable for indirect, incidental, special, or consequential damages, including missed pickups, hauler fees, fines, or property issues arising from a message that was late, inaccurate, or never delivered. Our total liability for any claim is limited to the greater of fifty dollars or the amount you paid us in the twelve months before the claim.
Indemnification
You agree to indemnify HeyBinny against claims arising from your misuse of the service or from enrolling a phone number you were not authorized to enroll.
Changes to these terms
We may update these terms and will post the revised version here with a new effective date. Continuing to use the service after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in El Paso County, Colorado.
